TERMS AND CONDITIONS
1.Interpretation
In this Agreement the following words shall have the following meanings:
BOOKING FEE means a non-refundable payment of £200 of the Total Fee payable by You to Blooms Floristry
DATE OF VENUE means the day on which the planned social occasion will take place.
TOTAL FEE means the total amount agreed between the Parties and payable by You to Us
VENUE means the space, location, or place where the Props are to be delivered and set up
2.General
Please read this Agreement carefully as it constitutes a legally binding contract between Blooms Floristry and You.
You acknowledge that You have read, understood, and agree to be bound by all the terms and conditions contained in this Agreement.
Full payment must be made 4 weeks before the date of the Event. To confirm your booking a non-refundable Booking Fee of £200 of the Total Fee must be made at the time of acceptance by Us of the booking.
3.Fees and Payments
Please make all payments including Booking Fee to Blooms Floristry. All payments for services and goods must be made via bank transfer or cash. Specific banking details including account name, sort code & account number we be provided on your invoice.
All payments must be made via bank transfer or cash. We do not accept credit cards, debit cards, cheques or any other payment methods.
Our minimum order is £500 on personal flowers not including Our set up fee.
4.Consultations and visits
All wedding consultations will be made by appointment only. The initial and final consultation are complimentary. We will be available for contact by phone and email at any stage to answer any questions and queries you may have. Venue visits will be chargeable for time and mileage.
5. Wedding flower orders.
Any changes made to a wedding order must be submitted in writing by the bride, groom or appointed acting party to info@bloomsfloristry.com. We order your wedding flowers approximately ten to fourteen days before your wedding date, dependent on type of flowers chosen. You will not be allowed to make any changes after the order has been placed without additional fees. We will however try to make small changes where possible to accommodate your needs.
Items can be substituted but cannot be removed to reduce the price originally quoted and agreed on. The original overall price quoted and agreed on cannot be reduced at all.
6. Agreement Term (Duration)
Unless otherwise specified, this Agreement will take effect on the date you sign these terms and conditions (the “Effective Date”) and shall continue in full force and effect until the Event has concluded.
7. Event Changes / Cancellations
a) Any request for a change in the Event Date must be made at least 8 weeks in advance of the original Event date. Change is subject to availability, and receipt of a new Agreement.
b) If you wish to cancel the Event, you must notify Us as soon as possible. You acknowledge and accept that the Booking Fee is non-refundable. We shall refund all other fees already paid if we are able to secure another Event from another customer for the same date. If we fail to find a replacement customer, then the following Cancellation Fees shall be payable by You:
Cancellation Fee Payable by You to Us
Within 6 months of Event 50% of Total Fee
Within 3 months of Event 75% of Total Fee
Under 1 month of Event 100% of Total Fee
c) Once final payment of the Total Fee has been made, amendments cannot be made to Your original order. However, additional items can be ordered once you have accepted a new quote.
d) All requests for Event changes or cancellations must be emailed to: info@bloomsfloristry.com
8.Flowers.
Blooms Floristry does not accept liability for wilting of real flowers due to excess heat at Your Venue. We will try to the best of Our ability to meet Your floral requirements, but due to seasonal changes and availability, you accept that We cannot accept responsibility for colour, variety, and price changes of a flower.
As fresh flowers and foliage are living products, there are occasions when varieties may be unavailable. Whilst every effort is made to source products accordingly, sometimes we are unable to obtain a particular type of flower. All fresh flowers and foliage are subject to availability and stringent quality checks, as such Blooms Floristry reserve the right to use a similar flower in place of the previously chosen flower.
9. Governing Law
a) This Agreement shall be construed and enforced according to English Law.
b) Any dispute or difference which may arise in relation to any matter arising under this Agreement, shall be settled amicably and in good faith between you and Blooms Floristry, prior to resorting to arbitration.
10. Severability
If any term of this Agreement is held by a court of competent jurisdiction to be invalid or unenforceable, then this Agreement, including all of the remaining terms, will remain in full force and effect.
11. Counterparts
The exchange of copies of this Agreement and original signatures by electronic mail transmission shall constitute effective execution and delivery of this Agreement in place of the original Agreement for all purposes.
12. Payment of services
"The price for the Goods/Services provided under this Agreement is the fixed price stated in the Order Confirmation/Invoice (the "Contract Price"). Once an order is accepted and agreed, the Contract Price shall be set and is not subject to variation or renegotiation by the client”
The Contract Price is based strictly on the 'Scope of Work' detailed in the order confirmation/invoice. Any request by the Client for changes to the Scope of Work, including changes in volume, services, or delivery locations, must be submitted in writing. Blooms Floristry will then provide a revised quotation for the proposed changes, and no changes will be implemented until mutually agreed and signed by both parties, with the corresponding price adjustment clearly defined."
